By registering and/or using the Rumah Sakit Pondok Indah Group website ("WEBSITE"), you as a user or party who register a Child or person under your guardianship/care ("You") have agreed and have read, understood, known and accept the Terms and Conditions set out herein (“Terms and Conditions”) and the attached privacy policy (“Privacy Policy”). These Terms and Conditions and the attached Privacy Policy constitute an agreement regarding the procedures and conditions for using the WEBSITE between you and us, namely PT Binara Guna Mediktama and its subsidiaries ("We").


You agree and acknowledge that We have the right and authority to update these Terms and Conditions from time to time and We will notify you of these updates when you access the WEBSITE. In the event that you cannot agree to the Terms and Conditions and this Privacy Policy, you can stop using the WEBSITE and delete your account if you have registered as a WEBSITE user.


A. General Provisions

  1. An internet connection is required to be able to use the WEBSITE. All costs arising from connecting Your electronic device to the internet network are Your sole responsibility.
  2. This WEBSITE functions to provide information regarding Us or the hospitals we manage ("Rumah Sakit Pondok Indah Groupl") and obtaining Our services (as defined below) at Rumah Sakit Pondok Indah Group.
  3. The types of services at Rumah Sakit Pondok Indah Group that can be used via the WEBSITE shall be:
  4. Appointment Services: You can make an appointment and teleconsultation with one of the doctors at Rumah Sakit Pondok Indah Group and You can also reschedule or cancel the appointment.
  5. Patient Portal Services: You can access your visit schedule, doctor consultation history, vaccine history and laboratory examination history.
  6. Article and Health Information Services: You can access articles and health information on this service which we will update from time to time.

  9. Other Services: You will get other additional services that are currently being developed by Us. (hereinafter shall be severally or collectively referred to as the “Services”).
  10. To avoid doubt, You should understand and acknowledge that the information displayed on the Information Service may be different from actual conditions and based on our discretion, appointments via the Appointment Service can be changed or canceled at any time by Us.
  11. You should understand the appointment schedule under the Appointment Service may change in the event that a doctor is not available.
  12. You may cancel Your Appointment Service no later than 3 (three) hours before Your scheduled appointment. In the event that You do not provide confirmation of cancellation and/or You do not appear at the Appointment Service schedule that You made for 3 (three) consecutive times within a certain period of time in accordance with our provisions starting from the first time you made the Appointment Service, then We have the right to not to grant You access rights to use the Appointment Service on the WEBSITE for a certain period of time in accordance with Our provisions. You can still make appointment services outside the WEBSITE by calling Our Call Center number.
  13. You should understand that if You need an emergency medical condition, We do not recommend that you use the services on this WEBSITE.
  14. You should understand that in the event that You wish to carry out a transaction refund process for canceling the services that You previously registered on the WEBSITE, You are required to come directly to Rumah Sakit Pondok Indah Group depending on the hospital You choose.
  15. We reserve the right at any time to change, delete, and/or apply new Terms and Conditions in these Terms and Conditions and Privacy Policy. Changes to the Terms and Conditions and Privacy Policy will become effective immediately and will be notified to You on the home page (banner) when You access the WEBSITE for the first time after the changes are effective. We recommend that You read and check the Terms and Conditions and Privacy Policy pages carefully and check from time to time for any changes. Your continued use of the WEBSITE will be deemed as to constitute agreement to abide by the changes to the Terms and Conditions of these Terms and Conditions.
  16. We reserve the right at any time to change, delete, reduce, add and/or update features or facilities on the WEBSITE. Your continued use of the WEBSITE will be deemed as an agreement to changes, deletions, reductions, additions and/or updates to the WEBSITE's features or facilities.
  17. By providing information regarding Your personal data requested on the WEBSITE ("Personal Data") and Your health history, You hereby give your consent so that We can store your Personal Data and health history and display it in your account. The confidentiality of Your data will be used by Us for the purposes of the our services which You have agreed to in accordance with applicable laws and regulations and the Privacy Policy. The attached Privacy Policy (as updated from time to time) forms an inseparable part of these Terms and Conditions.
  18. We reserve the right not to process registration, limit or terminate use of the WEBSITE if we have reason to suspect that You have violated the provisions of these Terms and Conditions and/or applicable laws and regulations.


B. Terms of Use of the WEBSITE

  1. You represent and guarantee that You are an individual who has the right to enter into a binding agreement based on the laws of the Republic of Indonesia and that you are at least 21 (twenty one) years old or married, in good health and mental condition and are not in under guardianship. We reserve the right to close or cancel Your account if this is not true. You further represent and warrant that You have the right, authority and capacity to use the WEBSITE and will at all times comply with these Terms and Conditions. If You register on behalf of Your child or someone under Your guardianship, You also declare that You are authorized to act for and on behalf of that person and to enter into and bind that person to the Terms and Conditions along with the Privacy Policy of the WEBSITE. You are aware that medical information is personal and confidential information and in the event that Your child or someone under your guardianship has reached the age of 21 (twenty one) years or is married then You declare that You no longer have the right to obtain, receive, see and/or use data related to their medical information unless otherwise determined by Your child or someone under Your guardianship/care.
  2. If You, as a WEBSITE user, are not yet 21 (twenty one) years old or unmarried and are in good health and mental condition, then You declare that you have given permission and/or power of attorney to Your parent or guardian who registers a WEBSITE account for Your name to obtain and/or receive and/or use some or all of Your medical information for the needs of Our Services.
  3. When You register an account, You are asked to provide Personal Data information in the form of name, date of birth, email address and telephone number. Information related to the Personal Data provided will only be used by Us for the purpose of providing services on the WEBSITE, email address and telephone number for login accounts, accessing the Patient Portal and for other purposes that You have agreed to in accordance with the provisions of applicable laws and the Privacy Policy. You must provide true, accurate and complete information, as well as update information and agree to provide us with any proof of identity that we may reasonably request to verify your account registration and/or changes to information on your account.
  4. If the information You provide is incorrect, then all risks related to Your account are Your own responsibility, and You hereby release Us from all responsibilities and claims arising from the processing of the Personal Data You provide to Us.
  5. After You register an account on the WEBSITE, You will receive an email that is used to verify Your account before Your account can be used.
  6. Once Your account is active, You can integrate Your medical information on the WEBSITE, You will receive a One Time Password (OTP) which will be used to verify the integration of Your medical information on the WEBSITE, You are obliged to maintain the confidentiality of the OTP You receive and any identification provided to You with Your account or Personal Data. You also promise not to hand over, transfer or authorize anyone else to use Your identity or use Your account. In the event that there is a disclosure of Your OTP and/or account which occurs through no fault of Ours, in any way which results in unauthorized and unauthorized use of Your account or You, then You release us from all consequences or responsibilities that may arise from the use which is unauthorized and without authority over Your Account or You.
  7. If there are changes to the Personal Data that You provide to Us, for example, if You change Your email address, telephone number, You are required to update Your information details by coming directly to Us to make changes and/or updates to Your data.
  8. You understand and comprehend that the Medical Information provided by Rumah Sakit Pondok Indah Group through the Patient Portal Service on the WEBSITE is for the sake of improving services to You as well as for Your own convenience and interests in accessing Medical Information and/or downloading Medical Information relating to Yourself. You also understand and agree that Rumah Sakit Pondok Indah Group has full discretion based on its own consideration, to limit the display of certain data (selected data) displayed in the WEBSITE features.
  9. You agree that all forms of Use of Medical Information displayed on the Patient Portal Service on the WEBSITE and/or Medical Information that You download on Your device is at Your own risk, and You hereby release Rumah Sakit Pondok Indah Group from all responsibility due to the processing of data contained in the WEBSITE Services.
  10. You are not advised to provide any Medical Information contained on the WEBSITE and/or downloaded Medical Information to any party. If You provide Your medical information to any party, then all risks related to Your medical information are Your own responsibility, and You hereby release Us from all responsibilities resulting from Your provision of medical information.
  11. You further declare that You also understand and accept that there is a risk of unauthorized access or Use of the device You Use and/or Your account on the WEBSITE which is beyond the control of Rumah Sakit Pondok Indah Group and/or occurs due to Your negligence, and therefore is Your personal responsibility. For this reason, You hereby release Rumah Sakit Pondok Indah Group from all claims, consequences, compensation or responsibilities that may arise from unauthorized access or Use of Your device and account on the WEBSITE.
  12. You are prohibited in any way from providing Your WEBSITE account password to any party.
  13. You are advised to regularly check security settings and change passwords on Your WEBSITE account.
  14. You are not advised to leave Your mobile device out of sight or direct personal supervision, with the WEBSITE still open.
  15. You are obliged to provide information to Rumah Sakit Pondok Indah Groupin the event that there is a discrepancy in the Medical Information listed on the WEBSITE due to various reasons, including but not limited to, data maintenance requirements or technical problems.
  16. You are required to report to Us if You, for any reason, do not have control over Your account. You are responsible for every Use of Your account on the WEBSITE even if the Account has been misused by someone else.
  17. You may not harm, abuse, change or modify the WEBSITE in any way. We reserve the right to close or cancel Your Account and prohibit You from further Use of the WEBSITE if You Use the WEBSITE without complying with these Terms and Conditions.
  18. You promise that You will Use the WEBSITE only for the intended purpose of obtaining the Services. You are not permitted to misuse or Use the WEBSITE for activities that are contrary to the law, including but not limited to criminal acts of money laundering, theft, embezzlement, terrorism or fraud or things that cause inconvenience to other people.
  19. You acknowledge and agree that any information in any form, including but not limited to video, audio, images or writing contained in the WEBSITE have their respective intellectual property rights (including but not limited to trademark and copyright rights). You are not permitted to use, modify, facilitate, distribute and/or mutilate the intellectual property rights without permission from the owner of the intellectual property rights as regulated in the applicable laws and regulations.
  20. When accessing and using the WEBSITE including any features and Services, You are not permitted to:
  21. transfer Your account on the WEBSITE to another party without our prior approval.
  22. spread viruses, spam or other similar technology that can damage and/or harm the WEBSITE and other Users.
  23. placing information or other applications that violate other parties' intellectual property rights on the WEBSITE.
  24. harvest or collect Personal Data from other Users, including but not limited to email addresses, without the consent of that User.
  25. Use the WEBSITE for things that are prohibited under applicable laws and regulations.
  26. Use the WEBSITE to distribute advertising or other materials.
  27. You understand that all articles regarding health and nutrition that We display are only general in nature and are Used solely to educate consumers. Any part of the articles we display cannot be considered and cannot be used as a substitute for medical advice, diagnosis or treatment. Although various efforts have been made to display data and/or information as accurately as possible, We are not responsible for any errors and delays in updating data or information, or any losses arising from actions related to the Use of the articles, data/information and presentation time presented on the WEBSITE.
  28. You understand that all drug information that We display is only general in nature and is for information only. We are not responsible for any errors and delays in updating data or information, or any losses arising from actions related to the Use of articles, data/information and presentation times presented on the WEBSITE.
  29. By providing information (including in this case Your specific geographic location as obtained from Your hardware GPS data) to Us, You represent that You have the right to provide Us with information that will be used by Us either for this WEBSITE or, with Your consent First, other health-related applications that are being developed by Us.


C. Intellectual Property Rights

  1. We are the sole owner of the name, icon and logo of Rumah Sakit Pondok Indah Group as well as the features contained in the WEBSITE, which are copyrights and trademarks protected by the laws of the Republic of Indonesia. It is strictly prohibited to Use, modify or install such names, icons, logos, brands or features without our written approval.
  2. All intellectual property rights contained in the WEBSITE are based on the laws of the Republic of Indonesia, including in this case the ownership of intellectual property rights over all WEBSITE source code and intellectual property rights related to the WEBSITE. For this reason, You are prohibited from violating the intellectual property rights contained in this WEBSITE, including modifying, derivative works, adapting, duplicating, copying, selling, reproducing, hacking, reselling, and/or exploiting this WEBSITE including the use of this WEBSITE for unauthorized access, launching automatic programs or scripts, or any program that may hinder the operation and/or performance of the WEBSITE, or in any way reproduce or circumvent the navigational structure or presentation of the WEBSITE or its contents.
  3. You are only permitted to use the WEBSITE or a copy of the WEBSITE solely for personal, non-commercial, non-exclusive, non-transferable, non-assignable and non-sublicensable purposes.
  4. We have the full right to take legal action against any violations committed by You regarding intellectual property rights related to the WEBSITE.


D. WEBSITE Security and No Guarantees

  1. This WEBSITE is provided "as is" in the term that You acknowledge and agree that all risks arising from Your Use of the WEBSITE features remain entirely with You and You do not have the right to request any compensation from Us. We make no representations or warranties regarding:
  2. that this WEBSITE will be free from errors and/or defects or when operating in combination with other hardware, software, systems or data and that errors and/or defects in the WEBSITE will be corrected.
  3. availability and reliability of the WEBSITE and supporting servers that provide the WEBSITE, including being free from viruses and other dangerous components.
  4. that the features on the WEBSITE will meet Your expectations and needs.
  5. that the product quality, features and information available will meet Your expectations and needs.
  6. We always endeavor to keep this WEBSITE functioning and running smoothly. However, We are not responsible and will not be liable for the unavailability of the WEBSITE and/or Service features due to various reasons, including but not limited to maintenance requirements or technical problems. However, You acknowledge and agree that Internet transmission/access is never completely secure. Thus, We cannot guarantee 100% security of the data provided to Us by You, and therefore any message or information that You send or Use on the WEBSITE may be hijacked or taken by irresponsible third parties.


E. Limitation of Liability

  1. You understand and acknowledge that We are not responsible for injury, death or direct or indirect losses, material or immaterial arising from Your Use of the WEBSITE or any claims related to Use of the WEBSITE.
  2. By using the WEBSITE, You agree that We are not responsible to You or any other party for any losses caused by actions taken by You or other parties based on the services from the WEBSITE. The above provisions will remain in effect even if You do not Use the WEBSITE any more.


F. Others

  1. These Terms and Conditions apply from the moment You give Your consent to Use this WEBSITE and will continue to apply and bind You until we terminate these Terms and Conditions.
  2. We have the right to investigate and prosecute Our rights for any violations of these Terms of Use to the extent possible and permitted by law. You hereby acknowledge that We have the right to monitor access to Use of the site and WEBSITE to ensure compliance with these Terms and Conditions, or to comply with applicable regulations or orders or requirements of courts, administrative agencies or other government bodies.
  3. We have the right, without prior notification, to take necessary actions if manipulation/fraud is discovered, such as closing or canceling Your account and other things if indications of fraud, money laundering or violation by You of these Terms and Conditions are found and legal provisions that apply in the territory of Indonesia.
  4. These Terms and Conditions are regulated and interpreted based on the laws of the Republic of Indonesia and in connection with termination by Us as referred to in paragraph 3 above, You and We agree to waive the provisions of Article 1266 of the Civil Code which requires a court decision in terminating an agreement.
  5. All disputes that arise between You and Us in connection with the implementation of these Terms and Conditions will be resolved by deliberation to reach a consensus. In the event that the dispute cannot be resolved by deliberation, then You and We agree to resolve the dispute through the South Jakarta District Court.
